About Monica

Monica is a highly skilled media and commercial litigation lawyer with extensive experience in managing complex, high profile, multi-party litigation in the Supreme Court and Federal Court of Australia.  Her expertise spans defamation and media law, corporate governance advice, financial services litigation and contractual and commercial disputes.

In recent years, Monica has provided representation and advice to individuals, businesses, and media organisations on matters including defamation, brand and reputation management, copyright, and related issues. Monica also advises media organisations on pre-publication issues and acts on behalf of those organisations in disputes arising from the content of their publications.

Recognised for her pragmatic, strategic, and commercially focused advice, Monica tailors her approach to the unique needs of each client.  Her ability to solve complex challenges in demanding environments, coupled with her proven track record of exceptional client and stakeholder management, sets her apart in the field.

Monica is also the co-author of Social Media and the Law  (now in its 4th edition), a leading text in the field.

Experience

  • Defamation and Injurious Falsehood: representing and advising high profile individuals and businesses in defamation and injurious falsehood and providing strategic guidance on crisis communications and brand and reputation management.

  • Media and Social Media: providing prepublication advice to media organisations, publishers and freelancers including advice on copyright, contempt and privacy.  Monica has a particular interest in social media and acted on behalf of a high profile Australian in a first of its kind private criminal prosecution against Meta Platforms Inc.

  • Commercial Litigation:  representing corporations and high net worth individuals in commercial and contractual disputes, shareholder disagreements and breach of fiduciary duty claims.

  • Regulatory: providing guidance to individuals and businesses in relation to investigations and enforcement action by Australian regulators such as ASIC and the ACCC.

  • Class Actions:  representing both plaintiffs and defendants in shareholder class actions involving alleged breaches of the Corporations Act and the ASIC Act.

  • Represented shareholders in a multi-million-dollar class action in the Federal Court, Melbourne, which involved 14 respondents and a publicly listed company.

  • Successfully defended a Federal Court class action brought by landowners challenging a Ministerial decision under the Environmental Protection and Biodiversity Conservation Act 1999 (Cth) and the Judiciary Act 1903 (Cth).

  • Acted for a food and beverage distributor in response to ACCC investigations connected to Federal Court proceedings against Coles Supermarkets.

  • Successfully defended claims in defamation brought in the District Court by an engineer against Daily Mail Australia.

  • Successfully defended claims in defamation brought in the Supreme Court by a real estate agent and investment adviser against a broadcasting corporation.

  • Successfully defending claims in defamation brought in the District Court by a musician against a number of media organisations.
