Our process: What to expect

At BlackBay Lawyers, our process for debt recovery cases is designed to be as efficient and effective as possible. Our process typically includes the following steps:

  1. Initial consultation: We will schedule an initial consultation to discuss your debt recovery needs and assess the merits of your case. During this consultation, we will review any relevant documentation and provide you with pre-litigation advice on the best course of action to take.

  2. Letter of demand: If we determine that the debt is valid, we will draft and send a letter of demand to the debtor, providing them with a formal notice of the debt and a specific time frame to pay the debt.

  3. Legal proceedings: If the debt is not paid within the specified time frame, we will commence legal proceedings on your behalf to recover the debt. This may include filing a Statement of Claim, summons, or originating process.

  4. Enforcement: If the debtor still fails to pay the debt, we will take enforcement action to recover the debt. This may include applying for a garnishee order, writ of execution, or bankruptcy notice.

  5. Debt negotiation: In some cases, it may be possible to negotiate with the debtor to reach a payment plan that is acceptable to both parties. We will work with you to negotiate a fair and reasonable payment plan to recover the debt.

  6. Alternative Dispute Resolution: We also offer alternative dispute resolution methods such as Mediation, Conciliation and arbitration to resolve disputes in a timely and cost-effective manner.

Throughout the process, we will keep you informed of any developments in your case and provide you with regular updates on the progress of your debt recovery. Our goal is to recover your debt in a timely and cost-effective manner, and we will work closely with you to ensure that your needs and objectives are met.
