Competition and Consumer Litigation Lawyers

Competition and Consumer Litigation

Competition and consumer litigation refers to legal proceedings that involve disputes related to competition and consumer laws. These disputes can arise in a variety of contexts, including disputes between businesses, disputes between businesses and consumers, and disputes between businesses and regulatory bodies such as the Australian Competition and Consumer Commission (ACCC).

At BlackBay Lawyers, we offer a range of services to help clients navigate competition and consumer litigation, including:

  1. Representation in court: Our team of experienced litigators can represent clients in court proceedings related to competition and consumer law, including disputes over alleged breaches of the Competition and Consumer Act 2010 (Cth) and other relevant legislation.

  2. Mediation and alternative dispute resolution: We can also assist clients in resolving disputes through alternative dispute resolution methods such as mediation, which can be a more cost-effective and efficient way of resolving disputes.

  3. Advice on compliance and regulatory issues: We can advise clients on compliance with competition and consumer laws, including providing guidance on how to avoid breaches and disputes in the first place.

  4. Advocacy and representation before regulatory bodies: Our lawyers can also represent clients in investigations and proceedings before regulatory bodies such as the ACCC.

An example of a competition and consumer litigation case could be a business being taken to court by the ACCC for alleged breaches of the Australian Consumer Law, such as making false or misleading representations to consumers. The business would then hire BlackBay Lawyers to represent them in the court proceedings, including arguing their case and negotiating a settlement or resolution.

Competition & Consumer Information

What is the Australian Competition and Consumer Commission (ACCC), and what does it do?

The Australian competition and consumer commission (ACCC) is an independent Commonwealth statutory body charged with enforcing the Competition and Consumer Act of 2010 (which has replaced the former Trade Practices Act), Australian Consumer Law (ACL), and other relevant legislation, as well as encouraging fair trading, promoting competition, and regulating anti-competitive behaviour.

The Australian Competition and Consumer Commission (ACCC) is responsible for implementing and enforcing the ACL together with the Australian Securities & Investments Commission (ASIC) and the relevant state consumer protection agencies.

Essentially, if you've ever sold or purchased a product or service, the ACL is likely to cover them.

If you operate a business that sells items or services, you might want to consult with an experienced competition and consumer law lawyer about ACCC's rules since these competition and consumer regulations may well apply to you. It is critical for businesses and individuals to understand their responsibilities in order to avoid breaching them, which can be quite costly.
